Our total aggregate liability to you for all claims arising from or relating to our services shall not exceed the greater of the amount you paid us in the twelve months preceding the claim or one hundred euros. This limitation applies regardless of the legal theory on which the claim is based, whether contract, tort, strict liability, or otherwise.

4.3 Consequential Damages Exclusion

Under no circumstances shall we be liable for any consequential, incidental, indirect, special, or punitive damages arising from your use of our services, even if we have been advised of the possibility of such damages. This exclusion includes but is not limited to damages for loss of business, loss of profits, business interruption, loss of business information, or any other pecuniary loss.

4.4 Force Majeure Provisions

We shall not be liable for any failure or delay in performing our obligations under these Terms and Conditions where such failure or delay results from any cause beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

7.1 Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Denmark, without giving effect to any principles of conflicts of law. You agree that any legal action or proceeding arising from or relating to these terms or your use of our services shall be brought exclusively in the courts located in Copenhagen, Denmark, and you irrevocably consent to the jurisdiction of such courts.

7.2 Dispute Resolution Procedures

Before initiating any formal legal proceedings, we encourage you to contact us directly to seek resolution of any disputes. Many disputes can be resolved quickly and amicably through direct communication. We commit to working with you in good faith to resolve any concerns.

If a dispute cannot be resolved through direct negotiation within 30 days, either party may pursue formal legal remedies. Both parties agree to make reasonable efforts to resolve disputes through mediation or other alternative dispute resolution methods before resorting to litigation.

7.3 Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration. If this waiver is found to be unenforceable, then the entirety of this dispute resolution provision shall be null and void.

8.1 Severability Clause

If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions. The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely reflects the original intent.

8.2 Entire Agreement

These Terms and Conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Inkblot Fox regarding your use of our website and services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter.

8.3 Waiver

No waiver of any term of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Inkblot Fox to be effective.
